Bid bonds and performance guarantees: a guide for contractors

How insurance bonds work, why employers ask for them, and how to make sure a missing guarantee never costs you a tender.

If you tender for government, parastatal or large private-sector contracts in Zambia, you will regularly be asked to provide a bond or guarantee. These instruments give the employer confidence that you will honour your commitments — and having the right bond, on time, can be the difference between winning and losing a contract.

What is an insurance bond?

A bond is a three-party agreement. The insurer (the surety) guarantees to the employer (the beneficiary) that you (the principal) will meet a specific obligation. If you fail to do so, the employer can claim against the bond up to its stated value, and the insurer will then seek to recover that amount from you. A bond is therefore not insurance for your benefit; it is a form of credit that the insurer extends on your behalf.

The most common types

Bid bonds accompany a tender and assure the employer that, if your bid is accepted, you will sign the contract and provide any required performance security. Performance bonds guarantee that the contract will be completed in accordance with its terms. Advance payment guarantees protect an employer who pays part of the contract value up front. Retention bonds allow retention monies to be released early, replaced by a guarantee for the defects-liability period.

Why use an insurance bond rather than a bank guarantee?

Bank guarantees usually require cash collateral or consume part of your credit facilities, restricting the working capital you need to deliver the project. Insurance bonds are typically underwritten on the strength of your financial position and track record, leaving your bank lines free for operations.

How to prepare

Insurers will want to see recent audited financial statements, company registration documents, evidence of similar contracts completed, and the tender or contract documents themselves. Having these ready in advance makes it possible to turn bond applications around quickly — which matters when tender deadlines are tight.
